Welcome to TomPal: Recipe Manager!

These Terms of Use ("Terms") constitute a legally binding agreement between ASTRONIX LLP ("we," "us," or "our"), a limited liability partnership registered in England and Wales (Company Number: OC458462), and you, the user ("you" or "your"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, do not use the App.

1. Description of the App

TomPal: Recipe Manager ("TomPal" or the "App") is a recipe management application that allows you to import, scan, organise, and cook recipes. Core features include:

Free Version: A selection of features is available at no cost.

Premium Subscription: A paid subscription unlocks additional features and functionality. Subscription options and pricing are displayed within the App at the point of purchase.

You may use TomPal without registering an account. If you choose not to register, your data is stored locally on your device. If you delete the App or request deletion of your data, locally stored data will be permanently lost and cannot be recovered.

You may register an account using Sign in with Apple, Sign in with Google, or email and password. A registered account allows you to restore your recipes and data if you log out or change devices.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. If you become aware of any unauthorised use of your account, please contact us immediately at support@tompal.app.

4. License

Grant of License. By complying with these Terms, we grant you a limited, worldwide, royalty-free, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the App strictly for personal, non-commercial purposes.

Use Restrictions. Except as expressly permitted by these Terms, you may not:

When you use TomPal, you may submit content such as recipe URLs, images, screenshots, and text ("User Content"). You are solely responsible for the User Content you submit.

By submitting User Content, you confirm that:

We do not claim ownership of your User Content. However, by submitting it, you grant us a limited licence to process it for the sole purpose of providing the App's features to you (such as extracting and displaying recipe data).

Please be aware that recipes imported from external sources (websites, social media, cookbooks) may be protected by copyright. It is your responsibility to ensure that your use of any third-party content complies with applicable law and the terms of the source platform.

6. AI Processing

TomPal uses AI services provided by third parties — including Inception Labs (inceptionlabs.ai), Google (google.com), and fal.ai (fal.ai) — to process recipe content you submit. When you import a URL, upload an image, or paste text, that content may be sent to these services for processing.

By using these features, you acknowledge and agree that your submitted content may be processed by these third-party AI providers in accordance with their respective terms and privacy policies.

7. Subscriptions and Payments

Subscription. TomPal offers an auto-renewable subscription to unlock premium features. Subscription pricing and terms are clearly displayed within the App before purchase. BY PURCHASING A SUBSCRIPTION, YOU AUTHORISE THE AUTOMATIC RENEWAL CHARGE AT THE THEN-CURRENT SUBSCRIPTION RATE AT EACH RENEWAL PERIOD, UNTIL YOU CANCEL.

Billing. Payments are processed through your device's app store (Apple App Store or Google Play Store) using RevenueCat, a third-party subscription management platform. We do not have access to your payment card details.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds will be issued for unused portions of the subscription period.

8. Intellectual Property

All content within the App that is created by us — including but not limited to the App's design, interface, graphics, and original text — is owned by or licensed to ASTRONIX LLP and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any such content without our prior written permission.

Recipe content that you import from external sources remains the intellectual property of its original owner. TomPal does not claim ownership of third-party recipe content.

The App may connect to or link to third-party platforms, websites, and services, including social media platforms from which you import recipes. We are not responsible for the content, practices, or terms of any third-party platforms.

11. Nutritional, Allergen, and Ingredient Information

TomPal uses AI to extract and analyse recipe data, including ingredients, nutritional information, calorie counts, macros, and allergen details. This information is generated automatically and may contain errors, omissions, or inaccuracies.

We do not guarantee the accuracy, completeness, or reliability of any nutritional, calorie, ingredient, or allergen information displayed in the App. AI models can misread, misinterpret, or fail to detect ingredients and allergens present in a recipe.

You must not rely on the App as your sole source of allergen or nutritional information, particularly if you or anyone you are cooking for has a food allergy, intolerance, dietary restriction, or medical condition. Always verify ingredient and allergen information independently before preparing or consuming any recipe.

ASTRONIX LLP accepts no liability for any harm, illness, allergic reaction, or other adverse outcome arising from reliance on nutritional, calorie, ingredient, or allergen information provided by the App.

12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no guarantees that the App will be continuously available, error-free, or that recipe data extracted by AI will be accurate or complete. AI-generated recipe content should always be reviewed by you before use. USE OF THE APP IS AT YOUR OWN RISK.

13. Limitation of Liability

To the fullest extent permitted by law, ASTRONIX LLP shall not be liable for any incidental, special, exemplary, or consequential damages arising from or related to your use of the App, including but not limited to loss of data, inaccurate recipe extraction, service interruptions, or any other damages.

Our total liability shall not exceed the total amounts you have paid to us for the App in the twelve (12) months preceding the claim, or £10 (ten British pounds) if no payments have been made.

Your privacy is important to us. Please review our Privacy Policy at tompal.app for information on how we collect, use, and protect your data.

15. Rights and Terms for Apps (Apple)

This section applies to any version of the App that you acquire from the Apple App Store or use on an iOS device. Apple has no obligation to provide maintenance or support services for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if applicable.

Apple is not responsible for handling any claims related to the App, including: (a) product liability claims; (b) any claim that the App fails to meet any applicable legal or regulatory requirement; or (c) claims arising under consumer protection legislation.

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

16. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you directly inside the App the next time you open it. You will be asked to review and agree to the updated Terms before continuing to use the App. If you do not agree to the updated Terms, you may stop using the App and request deletion of your data by contacting us at support@tompal.app.

We also update the effective date at the top of this document whenever changes are made.

17. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Termination

We may, at our sole discretion, suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. Upon termination, your licence to use the App will immediately cease.

19. General

Entire Agreement. These Terms constitute the entire agreement between ASTRONIX LLP and you regarding the App and supersede all prior agreements.

Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the fullest extent allowed, and all remaining provisions will continue in full effect.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
